Purchasing a property is a legal transaction. Whether you are buying an investment property with the intention to ‘buy and hold’, or you are buying a property for ‘development’ purposes, complications can and do arise – and can be costly if not handled swiftly and correctly.
A property lawyer’s role is to make sure that any issues are identified and resolved in timely manner – or prevented altogether!
This month we have two fantastic speakers talking to us about legal matters regarding the planning system and the planning approval process PLUS what to look out for when it comes to the laws relating to property investing.
This Month’s Topics & Speakers
Overview on planning law in VIC – the planning system and approval process!
Annabel Bainbridge is an accomplished senior lawyer with 13 years’ experience in private practice in Perth and Melbourne as well as a period as an in house lawyer at Telstra. Annabel has worked in a variety of legal areas, with a special interest and focus in planning law and property development, for the majority of her career.
Annabel has experience providing legal town planning advice, conducting planning due diligence on development proposals, liaising with Councils during the Council planning approval process and representing clients in applications at the Victorian Civil and administrative Tribunal (VCAT). Annabel has worked with town planners, traffic consultants, economists and other professionals required to address issues that arise in any specific proposal, at all stages of the development process.
Annabel will reveal to newcomers the players, tools and processes to ensure your property development proposal is permitted and lawful, and to help prepare for a smooth Council process when applying for a planning permit. The presentation will also provide a reminder to our more experienced developers facing more complex planning issues, of the potential town planning challenges and how best to avoid any adversarial situation.
Annabel will address the following:
- The planning system in Victoria – Council town planning schemes, land use zoning and online search tools we can use to find out more about the planning controls that affect the land you are considering developing.
- Example development – zoning and planning restrictions to consider. Is a planning permit for the proposed use and development required from Council? What is permitted and lawful? Common issues for objectors and Council.
- Application for a planning permit – summary of the steps in the Council process.
- The importance and value of planning due diligence early on in the development proposal and approval process.
- Applications for review at VCAT – what types of appeals can we expect from a Council decision, and how we can avoid them.
… and much more!
Make sure you come along and meet Annabel.
